The petitioner has prayed for bail in connection with Special Case No. 26 of 2019 arising out of Kadamkuan P.S. Case No. 122 of 2019 registered for the offence punishable under section 414 of the Indian Penal Code and sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act. As per allegation in the FIR, in course of patrolling two persons including the petitioner were apprehended on motorcycle. It is further submitted that on search six sachet of a white colour substance like smack is stated to have been recovered from possession of the petitioner while four sachet were recovered from co-accused Sagar Kumar.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.2253 of 2020(3) dt.20-03-2020 2/2 that petitioner has no criminal antecedent, he is in custody since 23.02.2019 and the case of the petitioner stands on similar footing to that of co-accused namely, Sagar Kumar, who has been enlarged on bail vide order dated 04.12.2019 passed in Cr. Misc. no. 48128 of 2019.

Having heard learned counsel for the parties and taking into consideration the period in custody, the petitioner having no criminal antecedent and grant of bail to the coaccused, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Special Case No. 26 of 2019 arising out of Kadamkuan P.S. Case No. 122 of 2019 on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge- XVII, Patna.
