2. The petitioner apprehends his arrest in a case registered for the offence under Sections 307, 504/34 of the Indian Penal Code and Section 27 of Arms Act.
3. As per the prosecution case, while the informant was going to his house at 8 P.M. than Raushan Kumar, Ravindra Roy, Jeetu Kumar, Premlal Mahto who were sitting at Gyatri Mandir surrounded the informant and on the order of this petitioner and Premlal Maho, co-accused, Roushan Kumar and Jeetu Kumar fired with arms upon the informant which hit at thigh and knee, thereafter the informant fell down and accused person fled away.
4. It is submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.12097 of 2024(3) dt.16-04-2024 2/2 petitioner is alleged only to be order giver. There is no allegation of assault. There is no allegation that he participated in the alleged occurrence. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Samastipur, in connection with Khanpur P.S. Case No. 166 of 2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
