The petitioner seeks bail in a case registered for the offences punishable under section 366, 366(A)/34 of the Indian Penal Code and section 4/6 of the POCSO Act. Statement of the victim has been recorded under section 164 of the Code of Criminal Procedure, 1973 in which she stated that she was forcibly kidnapped by Golden Ansari and the petitioner but the allegation of rape is against co-accused Golden Ansari only and it is only stated by the victim girl that the petitioner was also present at the time of her kidnapping. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the
