Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. In the present case, the petitioners seek bail in connection with Bhabua (Sonhan) P.S. Case No. 90 of 2021 registered for the alleged offences under Sections 147, 148, 149, 341, 323, 326, 337, 354, 427 and 448 of the Indian Penal Code. Allegedly, the petitioners along with other co-accused persons trespassed in the house of the informant and assaulted
Patna High Court CR. MISC. No.4102 of 2022(2) dt.08-06-2022 2/3 the informant and his family members and poured acid on the informant. The occurrence is stated to have taken place on account of land dispute.
It has been submitted by the learned counsel for the petitioners that there is a case and counter case between the parties due to some dispute over parking of a tractor. The petitioners have also received injuries and one of the persons from the petitioners' side received grievous injury from the acid burning. The petitioner nos. 1, 2 and 3 are in custody since 16.08.2021, the petitioner no. 4 is in custody since 25.08.2021 and the petitioner no. 5 is in custody since 18.09.2021. Learned APP has opposed the contention of the petitioners. He has submitted that acid was used in the assault. Having regard to the facts and circumstance and considering the fact that there is a case and counter case and both sides have received injuries along with period of custody, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua (Sonhan) P.S. Case No.90 of 2021, subject to the following conditions :
Patna High Court CR. MISC. No.4102 of 2022(2) dt.08-06-2022 3/3 (i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below.
(iii) In case of absence for three consecutive dates or in violation of the terms of the bail, the bail bonds of the petitioners will be liable to be cancelled by the court concerned.
