ANJANA MISHRA ORAL ORDER 08-03-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.09.2018 in connection with Maanpur P.S. Case No.64 of 2018 registered for the offence under Sections 147, 148, 149, 341, 323 and 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that no specific overt act has been attributed to the present petitioner, rather the same is on other accused persons. It is further submitted that the post-mortem report also indicates that no internal injury has been found on the person of the deceased. The cause of death has not been ascertained and the viscera has been sent for forensic examination.

Patna High Court CR. MISC. No.3315 of 2019(3) dt.08-03-2019 2/2 perusal of the case diary submits that though inquest report indicates some injury, but the doctor has opined that there is no external or internal injury.

Considering the aforementioned facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateV, Nalanda at Biharsharif, in connection with Maanpur P.S. Case No.64 of 2018.
