JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-06-2015 Heard learned counsel for the Petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Runnisaidpur P.S. Case No. 141 of 2014 registered for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.

It is submitted on behalf of the petitioners that both parties are agnate. There was free fight between them for which case and counter case has been lodged. The allegation against Randhir Paswan is that he assaulted Sudama Devi on her head and Rakesh Paswan assaulted Adarsh Kumar with iron rod on his right thumb. The main allegation is against co-accused Ashok Paswan against whom after investigation final form has been submitted

Patna High Court Cr.Misc. No.19776 of 2015 (2) dt.25-06-2015 and moreover, now the case has been compromised and compromise petition has also been filed. The injury found on Sudama Devi is simple in nature, as such, the petitioners deserve sympathetic consideration to which the learned A.P.P. does not oppose.

During investigation, the petitioners have been granted relief under Section 41 of the Cr.P.C also. In the facts and circumstances stated above, the petitioners, named above in case of surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Runnisaidpur P.S. Case No. 141 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Kamlesh/- U T
