The petitioner seeks bail in anticipation of his arrest in connection with Rasulpur P.S. Case No. 53 of 2020, dated 08.06.2020, instituted for the offences under Sections 363, 366-A and 34 of the Indian Penal Code. The daughter of the informant is said to have been kidnapped and forcibly married to the petitioner. It has been submitted on behalf of the petitioner that the accusation is absolutely false. The victim girl though claims her age to be 17 years but has stated in her Section 164 Cr.P.C. statement that because of being

Patna High Court CR. MISC. No.14606 of 2021(3) dt.16-02-2022 2/2 annoyed with her mother, who wanted to make her do the daily household chores, she ran away from the house. However, she has admitted that she is in love with the petitioner and would like to marry him.

Considering the afore-noted statement of the victim girl under Section 164 Cr.P.C., the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-XI, Saran at Chapra in connection with Rasulpur P.S. Case No. 53 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
