The petitioner seeks bail in Hathauri P.S. Case No. 5 of 2015, registered for the offences punishable under Sections 461, 379 and 411 of the Indian Penal Code.

Immediately after the theft in the house of the informant, the house of the petitioner was raided and from where as many as 27 different articles stolen from the shop of the informant, were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in jail since 28.01.2015. The petitioner has already remained in jail for about 5 months.

Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.18698 of 2015 (3) dt.25-06-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar, the learned Judicial Magistrate 1st Class, Muzaffarpur in Hathauri P.S. Case No. 5 of 2015.
