Petitioner is accused in connection with Shakurabad P.S. Case No. 116 of 2015 registered under Sections 302 and 34 of the I.P.C. and section 27 of the Arms Act. The accusation is that at the order of the petitioner, his son Pankaj Kumar took out pistol, in the meantime, Satyendra Kumar, another son of the petitioner, shot fire at Sanoj Kumar, son of the informant, who died on the spot.
Submission is that petitioner is named in the F.I.R. as an order giver, while the specific allegation against Satyendra Kumar, who shot fire on the deceased. It is also submitted that petitioner has no criminal antecedent and is in custody since
Patna High Court Cr.Misc. No.9454 of 2016 (3) dt.26-04-2016 2/2 29.10.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Jehanabad in connection with Shakurabad P.S. Case No.116 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
