The petitioners seek regular bail in connection with Falka P.S. Case No. 376 of 2018 registered for the offence punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016. The allegation is regarding recovery of 300 litres of illicit liquor from a Tempo in which the petitioners are said to have been travelling.

The learned counsel for the petitioners has referred to the FIR and has submitted that the driver of the Tempo has himself admitted that the illicit liquor did not belong to the

Patna High Court Cr.Misc. No.3069 of 2019(2) dt.23-01-2019 2/2 petitioners. It is further submitted that the petitioners have a clean antecedent and they are in custody since 13.09.2018. Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge (Excise Act), Katihar in connection with Falka P.S. Case No. 376 of 2018.
