The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

At the time of recovery of liquor from a pick-up van the petitioner was there, hence, under suspicion was arrested. Petitioner is in custody since 18.10.2020.

Submission is that the petitioner has got no criminal antecedent and he has no concern with the vehicle on which liquor was found or any concern with the liquor. Considering the submissions aforesaid and

No.14300 of 2021(2) dt.07-07-2021 2/2 completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gaya Excise P.S. Case No. 418 of 2020 (C.I.S. No. 418/2020), with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) shahzad/- U T
