JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner happens to be husband of the deceased, Sunita Devi whose marriage was solemnized with the petitioner in the year, 2008 and the deceased gave birth to a child in the year, 2009 out of the aforesaid wedlock but later on, some differences cropped up between the petitioner and his wife resulting filing of criminal case but on persuasion of the court and well-wishers, the petitioner took the deceased as well as his son to his home but later on, the deceased as well as her son were found missing and the informant lodged Bairiya P.S. Case No. 169 of 2014 which was registered under Sections-304B, 201, 120(B)/34

Patna High Court Cr.Misc. No.2507 of 2015 (4) dt.17-04-2015 of the Indian Penal Code.

Paragraph-14 of the case diary reveals that the petitioner was arrested and made his confessional statement before the police, leading to the detection of the place where dead bodies were recovered by the GRP, Gonda (Uttar Pradesh) and subsequently, the photographs of the deceased were identified by the witnesses.

Considering the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and, accordingly, his prayer for bail in connection with Bairiya P.S. Case No. 169 of 2014 pending in the court of Sri A. Kumar, Judicial Magistrate-Ist Class, Bettiah West Champaran stands rejected.
