Learned counsel for the petitioner submits that in view of decision of the Central Administrative Tribunal at Ranchi in O.A./051/00187/2016 dated 16-10-2017 as affirmed by the High Court of Jharkhand in W.P. (C) No. 1726 of 2018, the petitioner has approached the respondent No. 5 for correction of his date of birth.

The learned counsel for the respondent No. 5 submits that prima facie from perusal of the two orders, it appears that without impleading the respondent No. 5, the orders have been passed.

Since the petitioner's claim is limited to consideration of his representation for correction of his date of birth recorded in matriculation certificate, the writ application need not be kept pending as decision has to be taken by the respondent-board for consideration, in accordance with law. 4.

Writ application is disposed of.

The Secretary (Respondent No. 5) should consider the petitioner's representation and pass a speaking order, in accordance with law, within eight weeks from date of receipt/production of a copy of this order.
