Mr. Anil Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 Petitioner seeks regular bail in connection with Riga P. S. Case No. 135 of 2019 registered for the offences punishable under Sections 302/34 of IPC.

As per F.I.R. the father of the informant was murdered and informant suspects the hands of the petitioner. Submission of the learned counsel for the petitioner is that except suspicion, there is nothing against him. There is a land dispute between the parties and except that there is no other incriminating substance against the petitioner. Further submission is that father of the petitioner has already been granted privilege of bail by a Co-ordinate Bench of this Court, vide order dated 13.01.2020 passed in Criminal Misc. No. 81464 of 2019. Further submission is that he is in custody since 20.09.2019.

Patna High Court CR. MISC. No.2105 of 2020(2) dt.16-01-2020 2/2 Heard learned A.P.P. as well as learned counsel for the informant, who has opposed the prayer for bail. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Shri Rakesh Kumar, learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Riga P. S. Case No. 135 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
