Mr. Lakshmi Kant Sharma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 14-09-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/307/302 of the Indian Penal Code and Section 27 of the Arms Act. There is case and counter case of murder. Specific allegation is there against co-accused Sonu Kumar son of Praduman Sharma and Satish Sharma son of Dharmdeo Sharma to have fired from their rifle causing injury and death of Jitendra Sharma, the brother of the informant.

Submission is that no overt-act is alleged against the petitioner, who is in custody since 05.11.2020. Petitioner is victim of alleged over implication. Investigation of the case is already complete.

No.14388 of 2021(3) dt.14-09-2021 2/2 Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Shahpur P.S. Case No.315 of 2020 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
