Petitioner happens to be husband of the deceased and admittedly, after the occurrence deceased was brought to hospital by the petitioner.

In course of investigation, witnesses stated that it was coaccused Manish Kumar, who happens to be maternal nephew of the petitioner, gave fatal blow to the deceased due to some petty family feud. The confessional statement of mother of co-accused Manish Kumar was recorded at Para- 39 of the case diary and in the said statement, she also accepted the statement of other witnesses.

Patna High Court Cr.Misc. No.2599 of 2015 (3) dt.17-04-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Kusumbha) P.S.Case No.320 of 2014.
