2200 dated 06.10.2025 (Annexure P/11) by which, the Executive Engineer, without any Show Cause Notice and without any jurisdiction has debarred the petitioner permanently purportedly in exercise of powers under Bihar Contractors Registration Rules, 2007 read with Clause 33 and 4.8 of

(ii) Restraining the Respondents from proceeding further and giving effect to Office Order No. 403 dated 06.10.2025 as contained in Memo No. 2200 dated 06.10.2025 (Annexure P/11) during the pendency of the present writ application and/or the without the leave of this Hon'ble Court.
2. Learned counsel for the Respondents submits that, vide order dated 06.10.2025 (Annexure-P/11), the petitioner was debarred from performing the work in question. 3. Learned counsel for the respondents further submits that the Executive Engineer, vide letter no.2663 dated 23.12.2025, proceeded to rescind the agreement entered into with the petitioner. So far as the issue of debarment is concerned, it is submitted that in the event a fresh tender is invited in respect of the same work, the petitioner shall not be entitled to participate therein in view of the debarment order

4. Learned counsel for the petitioner submits that, if so be the position, he has no objection to the same and accordingly seeks permission to withdraw the present application.
5. In light of the submissions as made on behalf of the parties, the present application stands disposed of.
