1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Mairwa P.S. Case no.406 of 2022 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, 164 liters of liquor was recovered from the tempo which was being driven by the petitioner.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession or from his tempo. The petitioner runs the tempo for ferrying passengers. Any article which may have been recovered

Patna High Court CR. MISC. No.8408 of 2023(2) dt.29-04-2023 2/2 by the police personnel may belong to some passenger. The petitioner has no concern with the same. The petitioner is in custody since 5.11.2022, charge-sheet has been submitted in the case and he has no criminal antecedent under the Bihar Prohibition and Excise Act, 2016.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody since 5.11.2022, charge-sheet having been submitted in the case and the petitioner not having any criminal antecedent under the Bihar Prohibition and Excise Act, 2016, the petitioner is directed to be enlarged on bail in connection with Mairwa P.S. Case no.406 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Judge, Court no.1, Siwan.
