JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is specific allegation against the petitioner that he gave spade blow on the head of the deceased but submission on behalf of the petitioenr is that only one injury has been found on the person of the deceased, whereas the informant claimed that not only petitioner but several other persons assaulted the deceased. Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to grant privilege of bail to the petitioner, at least, at this stage, and accordingly, his prayer for bail in connection with Pratapganj P.S.Case No. 57 of 2014, pending in the court of Sub-Divisional Judicial Magistrate, Birpur stands rejected.
