====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Madhuban P.S. Case No. 131 of 2012 registered for the offence punishable under Sections 147, 148, 149, 302, 307, 504 and 506 of the Indian Penal Code.

As per FIR, petitioner is named in the FIR. There is specific allegation of assault by iron rod on the head of the deceased. It further appears that the case is of the year 2012 and the petitioner surrenders in the year 2019.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed to the petitioner. As he was residing outside, he could not appear earlier. Other co-accused persons have already been enlarged on bail by coordinate bench of this Court vide order dated 12.12.2018 in Cr.Misc.No. 67711 of 2018, vide order dated 17.12.2018 in

Patna High Court CR. MISC. No.4828 of 2020(3) dt.24-02-2020 2/2 Cr.Misc.No. 68667 of 2018 and vide order dated 10.06.2019 in Cr.Misc.No. 20485 of 2019.

Heard learned A.P.P. for the State.

Considering the submissions of both the parties and in view of the fact that the petitioner was absconding for a long time causing delay in conclusion of the Trial, I am not inclined to grant regular bail at this stage. However, the petitioner shall be at liberty to renew his prayer for bail after framing of the charge.
