Petitioners are accused in connection with Kuchaikote P.S. Case No. 199 of 2014 registered under Sections 363, 366A/34 of the I.P.C.

The prosecution case is that on 23.07.2014 at 4.30 pm. the Geeta Kumari, minor daughter of the informant Bishwamitra Sah was disappeared from Konhwa Bathan, regarding which Sanha was instituted. In course of search, the informant came to know that six persons, including the petitioners named in the F.I.R. under the conspiracy kidnapped his daughter

Patna High Court Cr.Misc. No.9516 of 2016 (3) dt.28-04-2016 2/2 with intention to perform marriage with her, as Jitendra Sharma has earlier given threatening for kidnapping of her daughter. Learned counsel appearing on behalf of the petitioners submits that it would appear from the F.I.R. that mere on suspicion petitioners and his family members have falsely been implicated in this case. It is also submitted that only some skeleton was found, which is said to be of a victim, daughter of the informant. Except that, there is nothing against the petitioners to show their involvement in the present case. Further submission is that petitioners have no criminal antecedent and are in custody since 01.12.2015.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj in connection with Kuchaikote P.S. Case No.199 of 2014.
