Case No.111/13. She is accused of committing the murder of the second wife of her husband by administering poison. The petitioner was arrested on 14.11.2013. She filed B.P. (k) No. No.40/14 before the court of Addl. Sessions Judge, Kishanganj which was dismissed through an order dated 22.3.2014.Hence, this application for bail under Section 439 of Cr.P.C. The petitioner contends that the investigation into the case has been completed and the police has filed the final report; and that there is no necessity to continue the petitioner in prison.
Learned A.P.P. opposed the application stating that the viscera report is still awaited.
Patna High Court Cr.Misc. No.17734 of 2014 (7) dt.20-01-2015 2/2 The accusation against the petitioner is, no doubt, serious. The fact, however, remains that the charge-sheet has been filed, and it is not alleged that the petitioner is of any notorious character or that she has committed any other crime. The Court is of the view that the petitioner deserves regular bail.
The petitioner is directed to be released on bail upon furnishing the bail-bonds of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of C.J.M., Kishanganj in connection with Terhagachh P.S. Case No.111 of 2013 (G.R. No.1739 of 2013), subject to the condition that she shall report to the concerned police station once in every month between 9:00 and 10:00 a.m. on the 1st Sunday.
