Heard the learned counsel for the petitioner and learned counsel for the informant.
The petitioner apprehends his arrest for the offences alleged under Section 498(A) of the Indian Penal Code, registered in connection with Kotwali P.S.Case No. 184 of 2021. As per allegation, the marriage of the informant was solemnized with the petitioner in the year 2018. She remained peacefully for some days in her matrimonial home. Thereafter, the petitioner started assaulting her and on

The learned counsel for the petitioner has submitted that the informant and her family members concealed the fact that the informant is a married lady and due to that concealment the marriage was solemnized. He has submitted further that the petitioner filed a case for divorce and when the notice was issued in that case the present FIR has been lodged. Learned counsel for the informant has submitted that the petitioner inflicted atrocity on the informant but the learned counsel is not aware whether the written statement has been filed on behalf of the informant in that divorce case or not. The present case has been filed after filing of the divorce case by the petitioner in which notice has been issued and despite notice the informant did not appear up-till now.
Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Kotwali P.S.Case No.
Patna High Court CR. MISC. No.3579 of 2022(2) dt.10-08-2022 3/3 laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
