JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-03-2023 After some argument, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition so far as petitioner no. 1 Sanjay Kumar Jha is concerned.
Permission is accorded. The anticipatory bail petition, in respect of petitioner no. 1, stands dismissed as withdrawn.
Petitioners no. 2 & 3 apprehend their arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.
As per the prosecution case, on 12.09.2022 at about
Patna High Court CR. MISC. No.3514 of 2023(2) dt.28-03-2023 2/3 5:00 PM, while the informant was sitting at his door with his friend Amarnath Sah, all the F.I.R. named accused persons, including petitioners, armed with weapons abused and assaulted the informant and his family members. Petitioner no. 2 Sanjeet Kumar Jha is alleged to have assaulted Raj Kumar Jha with iron rod as a result of which he sustained injury on his head. Petitioner no. 3 Sanny Jha is alleged to have assaulted with farsa on the head of informant.
It is submitted on behalf of petitioners that as per injury report, except the injury of Mukesh Kumar Jha, all other injuries sustained by the informant's side have been found to be simple in nature. There is case and counter case. Both sides sustained injury. Both petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners no. 2 & 3, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Mahnar P.S. Case No. 265 of 2022, subject to condition as
Patna High Court CR. MISC. No.3514 of 2023(2) dt.28-03-2023 3/3 laid down under Section 438(2) of the Code of Criminal Procedure.
