2. The petitioner seeks bail in connection with Nalanda Cyber P.S. case No. 99 of 2023, instituted for the offences under Sections 406, 419, 420, 467, 468, 471 of the Indian Penal Code and Sections 66(c), 66(D) of the I.T. Act.

3. It is alleged that this petitioner along with other coaccused used to cheat people in the name of providing them franchise of Monginis Food Pvt. Ltd. by creating forged website. It is further alleged that four mobile sets, one SIM card and one pen drive were recovered from possession of this petitioner.

4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.10.2023 and has no criminal antecedent. Charge-sheet has been submitted in this case. The

Patna High Court CR. MISC. No.6191 of 2024(2) dt.12-02-2024 2/2 petitioner has falsely been implicated in the present case. No specific overt act is alleged against the petitioner. Learned counsel for the petitioner further submitted that only one mobile phone was recovered from the possession of the petitioner which belongs to him but in order to save skin of real culprits, the recovery of four mobile sets has been shown from the petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, clean antecedent of the petitioner as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nalanda Cyber P.S. case No. 99 of 2023.
