The petitioner is apprehending his arrest in connection with Complaint Case No.142 (C) of 2017 , registered for offences punishable under Sections 498(A), 323 of the Indian Penal Code.
Allegation against the petitioner is of subjecting his wife (O.P.No.2) with cruelty and he tried to kill her with respect to demand of motorcycle and golden chain.
Submission of the learned counsel for the petitioner is that in the court below he has stated that he is ready to keep her and still he is ready to keep her with dignity and care and it
Patna High Court CR. MISC. No.3222 of 2019(6) dt.08-05-2019 2/2 appears from perusal of the record that earlier the notice was issued to the O.P.no.2 which has been received by the mother of the O.P.no.2 and a petition for jointness has also been filed by the petitioner, however, in spite of that O.P.no.2 has not appeared.
Heard learned A.P.P. also.
In such view of the matter, let the provisional bail already granted to the petitioner, vide order dated 24.1.2019 passed in the instant case, in connection with Complaint Case No.142(C) of 2017 is affirmed.
With the aforesaid direction, this application is allowed.
