JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-01-2022 Mr. Vasant Vikas, the learned Advocate for the petitioners seeks permission to withdraw the application with respect to petitioner No. 1, namely, Amod Rai, who has been arrested during the pendency of this application. Permission is granted.

The application with respect to petitioner No. 1 stands dismissed as having become infructuous.

The petitioner Nos. 2 and 3 seek bail in anticipation of their arrest in connection with Hajipur Town P.S. Case No. 402 of 2020, dated 22.06.2020, instituted for the offences under Sections 341, 323, 324, 379, 354 and 504/34 of the Indian Penal Code.

The petitioner Nos. 2 and 3 are the daughter-inlaw and the grandson of the informant respectively. Though there is accusation against petitioner Nos. 2 and 3 of assaulting and misbehaving with the female inmates, but the nature of accusation clearly reveals that there is domestic dispute between two brothers, one of whom is supported by the father of the husband of petitioner No. 2.

Considering the afore-noted background facts, the petitioner Nos. 2 and 3, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.13739 of 2021(2) dt.03-01-2022 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 402 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
