The petitioners seek bail in a case registered for the offences punishable under section 420, 467, 468, 471, 120B of the Indian Penal Code.
The petitioners were caught by the informant on the allegation that they lodged Runni Saidpur P.S. Case No. 649 of 2015 under section 392 of the Indian Penal Code which was found false after investigation and it also came to light that the petitioners had purchased some documents from Kabari of Nagaland with intent to evade the payment of road tax in
Patna High Court Cr.Misc. No.10231 of 2016 (2) dt.03-03-2016 respect of another truck.
Learned counsel for the petitioner drew my attention towards paragraph 12 of the case diary and submitted that Runni Saidpur P.S. Case No. 649 of 2015 was lodged by one Umesh Singh and not by the petitioners but so far as preparation of false document is concerned, the same is nothing but a highhandedness of the police.
Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, the petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No. 05 of 2016, G.R. No. 73 of 2016. (Hemant Kumar Srivastava, J) Amin/- U
