JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Parsa P.S. Case No. 364 of 2021 registered under Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 22.11.2021, charge-sheet has been submitted and is a persons with clean antecedent and allegation is of recovery of 2975.04 litres of liquor from a truck and three motorcycles.

Learned counsel for the petitioner submits that the petitioner was not arrested at the spot and his name transpired

Learned counsel submits that the petitioner had given the motorcycle to his friend and as such was not knowing for what use and purpose his friend has taken the motorcycle. Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted, is a person with clean antecedent and was not arrested from the spot, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II- cum- Special Judge, Excise Act, Saran in connection with Parsa P.S.
