The petitioner being the husband of the victim is languishing in custody since 17.10.2014 in a case registered for the offences punishable under Sections 304B and 201 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after three years of the marriage for non-fulfillment of the demand of dowry and disposing of the dead body. The impugned order reflects that the witnesses have suggested that there was quarrel between the petitioner and the victim and petitioner assaulted her on the alleged date of the occurrence.

Patna High Court Cr.Misc. No.18731 of 2015 (02) dt.25-06-2015 2/2 Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner in connection with Atri P.S. Case No. 165 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Gaya. Accordingly, the prayer for bail of the petitioner is rejected. It is expected from the learned court below to expedite the trial.
