JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-06-2015 Heard learned counsels for the petitioner and learned APP for the State.

The petitioner is languishing in custody since 04.12.2014 in a case registered for the offences punishable under section 25(1-B)a -26/35 of the Arms Act in connection with Chhatapur P.S. Case No.291 of 2014, pending before the SubDivisional Judicial Magistrate, Supaul. It is alleged that three miscreants robbed Rs.3550/- and a Nokiya mobile from the informant. On alarm being raised by the informant, the nearby people gathered and caught the petitioner at the spot with loaded country made pistol and robbed Nokiya mobile whereas two miscreants succeeded to escape from the scene.

Patna High Court Cr.Misc. No.20370 of 2015 (3) dt.25-06-2015 2/2 Considering the nature of accusation, this court is not inclined to grant bail to the petitioner at present. Accordingly, the application for bail on behalf of the petitioner is rejected. However, if the trial will not be concluded within a period of nine months, the petitioner would be at liberty to renew the prayer for bail.
