The petitioners seek bail in anticipation of their arrest in connection with Khutauna P.S. Case No. 78 of 2020, dated 14.06.2020, instituted for the offences under Sections 341, 323, 354(B), 504 and 34 of the Indian Penal Code.

Though the petitioners are alleged to have misbehaved with the prosecutrix, but the counsel appearing on their behalf has submitted that the petitioner No. 1 has also filed a case against the informant of the present case

Patna High Court CR. MISC. No.13960 of 2021(2) dt.25-02-2022 2/2 vide Khutauna P.S. Case No. 79 of 2020.

It has been submitted that the prosecutrix as well as the mother of the petitioner No. 1 fought over cutting of grass. It has further been submitted that the accusation also does not appear to be trustworthy.

Regard being had to the facts afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Jhanjharpur, Madhubani in connection with Khutauna P.S. Case No. 78 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
