The petitioner seeks regular bail in connection with Bounsi PS case no. 315 of 2017 registered for the offence punishable under Section 392 of Indian Penal Code. The allegation is regarding unknown miscreants having snatched a sum of Rs. 1,26,000/- from the informant. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and infact, neither any recovery has been made from his conscious possession nor any T.I. parade has been conducted so as to connect the petitioner with the alleged occurrence. It is further submitted that similarly situated co-accused persons have already been granted bail vide order dated 19.07.2018
Patna High Court Cr.Misc. No.3117 of 2019(2) dt.23-01-2019 2/2 passed in Cr. Misc. no. 42752 of 2018 and vide order order dated 06.10.2018 passed in Cr. Misc. no. 61055 of 2018. The petitioner is languishing in custody since 07.02.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Bounsi PS case no. 315 of 2017.
