2. The petitioner has preferred this application for grant of regular bail in connection with Buxar(Muffasil) P.S. Case No. 369 of 2024 dated 03.11.2024 registered for the offences punishable u/s 191(2), 191(3), 126(2), 115, 109, 118(2), 333, 351 and 352 of the Bhartiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have attacked on the informant's house and broke the lock of almirah. On being opposed by the informant and her family members, all the accused persons started assaulting them with weapons due to
Patna High Court CR. MISC. No.4147 of 2025(2) dt.25-02-2025 2/3 which her mother-in-law and five family members got injured thereafter her mother-in-law was taken to Sadar Hospital, Buxar and from where she was referred to Varanasi.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner. The allegation against the petitioner is general and omnibus in nature. The injury which is sustained by Rajani Kant and Chitranjan Singh is simple in nature whereas Santi Devi (mother-in-law of the informant) sustained lacerated wound on scalp which is grievous in nature. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. As per the impugned order dated 17.12.2024, the petitioner is in custody since 05.11.2024.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case and the nature of allegation levelled against the petitioner as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond
Patna High Court CR. MISC. No.4147 of 2025(2) dt.25-02-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Buxar in connection with Buxar(Muffasil) P.S. Case No. 369 of 2024.
7. The application stands allowed.
