According to the prosecution case itself, neither petitioner was caught on the spot nor anything was recovered from his conscious possession and it appears from perusal of the first information report that apprehended persons disclosed this fact that they used to sell stolen batteries to the petitioner and except the aforesaid material, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl.
