Mr. Gulnar Begum, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Deoria P. S. Case No.26 of 2019 registered for the offence punishable under Section 379 of IPC.

Prosecution case is that with respect to theft of the motorcycle, one Sunny Patel was arrested and on his confessional statement, petitioner has been made accused. Submission of the learned counsel for the petitioner is that except confession, there is nothing against the petitioner and said Sunny Patel has already been granted bail by a Coordinate Bench of this Court, vide order dated 22.10.2019, passed in Criminal Misc. No. 67458 of 2019 and he has also having the criminal antecedent. Further submission is that petitioner is in custody for more than 10 months.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri Nayan Kumar, learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Deoria P. S. Case No.26 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police station of his local area for a period of nine months, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.

Let a copy of this order be communicated to the S.S.P. Muzaffarpur, for needful.
