The petitioner seeks bail in Fatehpur P.S. case no. 313 of 2018 instituted for the offence under Sections 147,148,149,504, 427 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

In the written report, specific allegation of causing fire arm injury is against co-accused Chalitar Yadav and Musafir Yadav.

It is alleged in the written report that co-accused Chalitar Yadav made firing causing firearm injury to Binod Yadav @ Bhusan on his left hand whereas co-accused Musafir Yadav made firing causing firearm injury to Ajeet on his right shoulder. It is further alleged that on the order of Chalitar

Patna High Court Cr.Misc. No.2966 of 2019(2) dt.23-01-2019 2/2 Yadav this petitioner instigated to kill. But, the informant anyhow saved himself.

As such, there is no allegation of any specific overt against this petitioner.

Petitioner is in custody since 13.10.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the I/C ACJM -X, Gaya in connection with Fatehpur P. S. case no. 313 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
