The petitioner seeks bail in Kuchaikote P.S. Case No. 204/2017, instituted for offence under Section(s) 272, 273, 420 and 414 of the Indian Penal Code read with Section 30(a)(b)(c) of the Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that during patrolling duty police party reached at Jalalpur Check Post and found a truck in abandoned condition from which smell of rotten onion was coming. Thereafter the police made search and recovered 1764.360 litres of illicit liquor from aforesaid truck. Learned counsel for the petitioner has submitted that petitioner has subsequently been remanded in this case merely on suspicion alleging that petitioner is driver of aforesaid truck.
Patna High Court Cr.Misc. No.6077 of 2019(2) dt.04-02-2019 2/2 Seizure-list does not bear signature of petitioner. Petitioner is in custody since 02.08.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge 2nd-cum-Special Judge (Excise), Gopalganj in connection with Kuchaikote P.S. Case No. 204/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
