Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341,323,307,448 of the Indian Penal Code.

The petitioners allegedly caused injury at the head of the informant with lathi. The Doctor has found lacerated wound at both sides of the head, frontal as well as parietal region.

Since the petitioners had knowledge that their act might cause death, in my view, this is not a fit case for grant of anticipatory bail to the petitioners in connection with Shiv Sagar

Patna High Court CR. MISC. No.3381 of 2020(3) dt.26-06-2020 2/2 P.S.Case No.326 of 2019 pending in the court of learned S.D.J.M., Rohtas at Sasaram. Hence, prayer is refused. However, in the event of surrender of the petitioners, their prayer for regular bail shall be considered without being prejudiced by this order.
