The petitioners seek pre-arrest bail in connection with Chandan (Anandpur) P.S. Case No. 97 of 2018 registered
Patna High Court Cr.Misc. No.2925 of 2019(2) dt.23-01-2019 2/3 under Sections 147, 149, 447, 341, 323, 427, 337, 308, 379 and 504 of the Indian Penal Code.
Considering the omnibus and general nature of allegation of pelting stones on account of demolition of common passage, the petitioners, namely, Anil Yadav, Sunil Yadav, Degan Yadav @ Degan Mahatha, Jalo Yadav @ Jalo Mahatha, Baleshwar Yadav, Ghuran Kr. Yadav @ Guran Yadav, Bhudeo Yadav @ Budhdeo Yadav, Harish yadav @ Haresh Yadav @ Haresh Kumar and Manoj Yadav, in the event of arrest or surrender before the court below within six weeks from today, they are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Chandan (Anandpur) P.S. Case No. 97 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
However, prayer of pre-arrest bail of the petitioner no.7, namely, Huro Yadav @ Huro @ Huro Mahatha is rejected as there is specific allegation that he assaulted with stone causing injury to the mother of the informant on her head.
