JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Sursand P.S. Case No. 121 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 302 and 504 of the Indian Penal Code. As per FIR altogether 11 persons are named and there is allegation against them that they assaulted father of informant and there is also allegation of assault against some other accused persons to the informant and so far this petitioner is concerned, there is allegation of assault to the wife of informant and later on father of informant succumbed to the injuries. Submission of learned counsel for the petitioner is that FIR itself shows that he is neither assailant of the deceased nor there is allegation of assault against him to the informant or his wife or his father and there is land dispute between the

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Kavindra Kumar, Judicial Magistrate, Pupri, Sitamarhi, in connection with Sursand P.S. Case No. 121 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
