The petitioner seeks bail in connection with Katihar Town P.S. Case No.703 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is that Wakil Mahto, the brother of the informant, Pappu Kumar Mahto, was accompanied by the wife of the petitioner from his house on 30.10.2014 but the brother of the informant did not return till night and on 01.11.2014, the dead body of the brother of the informant was found in the orchard near the pond.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.18208 of 2015 (4) dt.09-09-2015 2/2 submits that it would appear from the F.I.R. that the deceased, the brother of the informant, was accompanied by the wife of the petitioner. Neither in the F.I.R. nor in the case diary, there is anything to connect the petitioner in the commission of the alleged offence. The petitioner being the husband of a lady, who had accompanied the deceased, has been falsely implicated in this case. The petitioner is in custody since 21.01.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No.703 of 2014.
