The petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Guddu Choudhary, son of the informant, was sleeping in his newly constructed house in the night. Balram Choudhary disclosed that two persons shot Guddu Choudhary dead. The informant suspected that the petitioner might have killed his son on account of land dispute.

There is no eye witness of the occurrence. Except suspicion, the police did not collect any tenable material to show the involvement of the petitioner in the case.

Patna High Court Cr.Misc. No.18638 of 2015 (4) dt.03-09-2015 2/2 Learned Additional Public Prosecutor for the State did not dispute the facts.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.
