The petitioner seeks bail in connection with Excise Case No. 109 of 2018 registered under Section-18(b)/8(c) of NDPS Act and 30(a)/56(d) of the Bihar Prohibition & Excise Act, 2016.
Earlier prayer for bail of the petitioner was rejected vide Annexure-1 to the present application taking into account that there was recovery of 20 kg. of opium and the petitioner was not entitled for bail under the provisions of Section-37 of NDPS Act.
A report has been called for from the trial court. It has been reported that out of nine prosecution
Patna High Court CR. MISC. No.4054 of 2022(3) dt.22-06-2022 2/2 witnesses, three prosecution witnesses have already been examined and the trial is likely to be concluded within a period of four months.
Considering the nature of accusation and stage of the case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. The trial court is directed to conclude the trial within a period of five months from the date of receipt/production of copy of the order.
