JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner.

The petitioner apprehends his arrest in connection with Bodh Gaya P.S. Case No. 28 of 2020, registered for the offences punishable under Sections 354, 354(D), 509, 511 of the Indian Penal Code.

Informant has stated in the written report that the petitioner who is devar of her sister is continuously blackmailing her after taking her photographs and he used to make hurdle in her proposed marriage by transmitting those photographs to the boy with whom the marriage of the informant has been settled. Learned counsel for the petitioner has submitted that the parents of the informant wanted to arrange the marriage of the

Patna High Court CR. MISC. No.14869 of 2021(2) dt.13-01-2022 2/2 informant with petitioner but they could not become successful and it was the reason that the petitioner has falsely been implicated in the case.

Considering the facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. Case No. 28 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. with the additional condition that at the time of his surrender the petitioner shall furnish an affidavit that in future he shall not be indulged in similar kind of offence.

Learned trial court shall be at liberty to cancel the bail bond if similar kind of allegation is found against the petitioner. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
