The petitioner seeks bail in connection with Sessions Trial No. 306 of 2012/17 of 2012 arising out of Nabinagar P. S. Case No. 12 of 2012 registered under Sections 304B and other sections of the I.P.C.

The prayer for bail of the petitioner was twice rejected by this court vide order dated 28.01.2013 and 17.09.2015 passed in Criminal Misc. Nos. 42537 of 2012 and 42925 of 2015 respectively.

A report was called for from the court of learned Additional Sessions Judge-IV, Aurangabad. From perusal of the report of Additional Sessions Judge-IV, Aurangabad, it appears that the witnesses have already been examined and the trial is

Patna High Court Cr.Misc. No.9537 of 2016 (3) dt.03-08-2016 2/2 pending on account of examination of investigating officer. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The same is rejected. The trial court is directed to examine the remaining witnesses forthwith.

The Superintendent of Police, Aurangabad is directed to ensure the attendance of the Investigating Officer and any other witnesses remained to be examined in connection with Sessions Trial No. 306 of 2012 arising out of Nabinagar P. S. Case No. 12 of 2012 within one month from the date of receipt of this order and the trial court shall conclude the trial within two months.
