The petitioner seeks anticipatory bail in connection with Makhdumpur ( Tehta O.P.) P.S. Case No. 335 of 2018, registered for offences punishable under Sections 304 (B)/34 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner, who happens to be the mother-in-law of the deceased, is of tortured the daughter of the informant and administered poison to her and ultimately she died.
Submission of the learned counsel for the petitioner is that there is no specific allegation has been attributed against the petitioner and the allegation is not specific against the petitioner and there is no concern with the petitioner because petitioner is residing separate from the deceased and her

Heard learned A.P.P. opposes the prayer for bail on the ground that F.I.R. itself shows that the deceased has disclosed the name of the petitioner and she along with others administered poison to her due to which she died. In view of the allegation against the petitioner, above named, I am not inclined to grant bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of the Court.
With the aforesaid observation, this application is dismissed.
