The petitioner seeks regular bail in connection with Koriansarai PS case no. 145 of 2018 instituted for the offences punishable under Section 30(a) of Bihar Prohibition & Excise Act, 2018.

The allegation is regarding recovery of 519 liters of illicit liquor from the house of co-accused person namely Sanjay Singh as also from the agricultural field of co-accused person namely Raghubansh Singh. It is alleged that the name of the petitioner has transpired on account of disclosure made by aforesaid two co-accused persons to the effect that the petitioner was involved in the business of trading of illicit liquor.

It is further submitted that the petitioner is accused in two other cases but he is on bail in one of the said cases. The petitioner is said to be languishing in custody since 02.12.2019. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the illicit liquor is not alleged to have been recovered from the possession of the petitioner or from his house, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Buxar in connection with Koriansarai PS case no. 145 of 2018.
