JUSTICE MIHIR KUMAR JHA ORAL ORDER 08-04-2015 Having regard to the fact that the prayer for bail of the petitioner has already been rejected by this Court on merit for the reasons incorporated in the order dated 07.10.2013 in Cr. Misc. No. 16139 of 2013, this Court is not inclined to reconsider the prayer for bail of the petitioner on merit.

Learned counsel for the petitioner has then submitted that the petitioner is in custody since 16.12.2012 and that the trial has commenced but only three witnesses have been examined as yet.

In that view of the matter, this Court would direct the Superintendent of Police of Siwan to must ensure that the remaining witnesses of prosecution in connection with Sessions Trial No. 116 of 2013, arising out of Asawan P.S.Case No. 67 of 2012, is examined within a period of six months so that the

Patna High Court Cr.Misc. No.21214 of 2014 (2) dt.08-04-2015 2/2 judgment can be delivered by the trial court in next three months. The trial of the petitioner must be brought to an end within a period of 09 months from the date of receipt of a copy of this order.

With the aforementioned observation and direction, this application is disposed of.

The copy of this order be sent immediately to the Superintendent of Police, Siwan as also to the concerned trial court for its compliance.
