JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but from perusal of the impugned order, I find that charge sheet was submitted against the petitioner on 30.04.2001 showing him absconder and, after that, he was remanded in the present case on 07.10.2015 but submission on behalf of the petitioner is that he was not aware about the institution of the present case and, as a matter of fact, he has been dragged in this case by the police. Moreover, even after submission of charge sheet showing him absconder, neither any notice nor any other process was ever served upon the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.15346 of 2016 (2) dt.18-04-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura in connection with Barbigha (Jairampur Morh) P.S.Case No. 16 of 2001/G.R. Case No.53A/2001, subject to the condition that one of the sureties must be a close relative of the petitioner and holder of landed property and the aforesaid surety will swear an affidavit disclosing as to how he/she is related with the petitioner.
